SYNOPSIS: This bill would propose a constitutional amendment providing that if a majority of the qualified voters fail to ratify Act 2011-315 of the 2011 Regular Session to reauthorize the Forever Wild Land Trust or reauthorize the Trust with fewer yes votes than this amendment, then the money that would have funded the Forever Wild Land Trust would be transferred to the Alabama Department of Child Abuse and Neglect Prevention, and to the Education Trust Fund to fund vocational education in high schools.

TO BE ENTITLED
AN ACT

Proposing an amendment to the Constitution of Alabama of 1901, to provide that if the electorate fails to reauthorize the Forever Wild Land Trust pursuant to Act 2011-315 of the 2011 Regular Session, or reauthorizes it with fewer yes votes than this amendment, then the monies that would have funded the trust would be transferred to the Alabama Department of Child Abuse and Neglect Prevention and to the Education Trust Fund to fund vocational education in high schools.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The following amendment to the Constitution of Alabama of 1901, as amended, is proposed and shall become valid as a part thereof when approved by a majority of the qualified electors voting thereon and in accordance with Sections 284, 285, and 287 of the Constitution of Alabama of 1901, as amended:

PROPOSED AMENDMENT

(a) If the electorate fails to ratify Act 2011-315 of the 2011 Regular Session on November 6, 2012, reauthorizing the Forever Wild Land Trust for a 20-year period, or if the electorate reauthorizes the Forever Wild Land Trust with a smaller number of yes votes than this proposed amendment, then all monies that would have been paid to that trust pursuant to Sections 7 and 13 of Amendment 543 of the Constitution of Alabama of 1901, now appearing as Sections 7 and 13 of Section 219.07 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, if the Trust had been reauthorized shall be paid as follows: 40 percent of the funds to the Alabama Department of Child Abuse and Neglect Prevention and 60 percent of the funds to the Education Trust Fund to fund vocational education in high schools.

(b) If the Forever Wild Land Trust is ratified with more votes than this proposed amendment then all monies shall be paid to the trust in accordance with Act 2011-315 of the Regular Session of the 2011 Legislature.

Section 2. An election upon the proposed amendment shall be held on Tuesday, November 6, 2012, and shall be in accordance with Sections 284 and 285 of the Constitution of Alabama of 1901, now appearing as Sections 284 and 285 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

"Proposing an amendment to the Constitution of Alabama of 1901, to provide that if the electorate fails to reauthorize the Forever Wild Land Trust pursuant to Act 2011-315 of the 2011 Regular Session of the Legislature, or reauthorizes the Forever Wild Land Trust with fewer yes votes than this amendment, all monies that would have been paid to the trust will be paid, 60 percent to the Education Trust Fund to fund vocational education in high schools and 40 percent to the Alabama Department of Child Abuse and Neglect Prevention.
